Appeals for
Applicant/Employee
Welcome to the new
railroad contractor screening program--e-RAILSAFE. If you are an
applicant/employee of a railroad contractor and want to appeal a a
decision made by the railroad, you are at the right place!
An applicant/employee
denied access to railroad property through the e-RAILSAFE credentialing
program will be directly informed of the decision by correspondence
from e-RAILSAFE. That letter will also include a description of the
appeals process available to the applicant/employee. e-RAILSAFE will
also inform the applicant's employer that credentials have been denied
to the applicant and provide appeals guidance to the contractor. Both
the contractor company and the contractor applicant/employee can appeal
directly to e-RAILSAFE.
An applicant/employee
will have 15 working days from the date posted on the letter received
from e-RAILSAFE to appeal the decision. If the applicant/employee
requires additional time to gather documentation, the
applicant/employee can notify e-RAILSAFE of his or her intention to
appeal and is afforded an additional 15 working days to submit their
appeal and supporting documentation.

include the following:

Once e-RAILSAFE receives
the appeal and supporting documentation (if applicable), e-RAILSAFE
must forward the applicant's appeal to the appropriate railroad within
24 hours for expedited review.
The railroad, must render
a decision on the appeal no later than 10 working days from the date of
receipt from e-RAILSAFE of the applicant's appeal. The appeals board
within each railroad will include a diverse work group from various
departments. The decision on the appeal will be communicated back to
e-RAILSAFE by the railroad. The applicant/employee as well as the
applicant's employer will be promptly notified by e-RAILSAFE of the
decision on the appeal.
